Property management services of real estate on a fee or contract basis. Commercial property management services. The Red Lion Quarter is a unique multi-use development in Spalding, Lincolnshire offering the following mix of business and leisure services:— Modern office and retail units — Meeting rooms and event space — Fine dining restaurant — College of further education the project was managed by a partnership consisting of South Holland District Council, East Midlands Development Agency, Lincolnshire Enterprise, Boston College and Lincolnshire County Council. Together they secured funding and developed a sustainable centre of mixed business use. South Holland District Council wishes to build upon the progress already achieved, and move Red Lion Quarter forward to develop fully the building’s potential and help deliver against theproject’s longer term aspirations. To do this, the Council intends to award a contract to one or more organisations for the future management and development of the centre. Ideally these will be organisations who not only possess the necessary skills, experience and, especially, business flair, but who also share the Council’s vision of what could be achieved. The Council is adopting a flexible approach to the exercise, in order not to stifle innovation or decide in advance the business model which may ultimately prove the most suitable. Organisations who are considering making a bid to be involved in the future of the Red Lion Quarter should note the following points: — The Council does not at this stage have in mind any specific structure for the new management arrangements.
Options which we anticipate may come forward from bidders include:
o A head-leasehold arrangement, in which a single organisation will be appointed by the Council. The contract may be on a "turn-key" basis, with the appointed organisation effectively assuming entire responsibility for the centre. Their role would include marketing the centre, letting the business space and retail units to suitable tenants (sub-leaseholders), collecting rents and looking after all tenancy matters, and "facility-managing" the building.
o A consortium bid from two (or more) organisations who can each contribute complementary expertise and experience, so that between them they can offer a complete, comprehensive solution. Within such a consortium, we would expect one of the constituent organisations to act as the lead member, and assume overall responsibility for the actions of the consortium, and be a single point of contact.
o Bids from organisations wishing to manage part of the building– for instance, the food court, or the office space. Such an approach may appeal to a suitably experienced firm who possess ambition in their own field, but does not wish to assume responsibility for elements with which they have less familiarity. (Such an approach would of course require the Council to receive a bid from another organisation to manage the rest of the building).
o Other solutions which represent viable routes forward for the centre.— In order to accommodate the range of solutions which may come forward, the Council has adopted a procurement approach designed to allow all solutions to be formally considered, and developed by discussion and negotiation,— The Council wishes to commence the new management arrangements as soonas practicable – an award of contract is envisaged during March 2012, with the new arrangements coming into effect as quickly as possible thereafter,
— The Council is prepared to consider solution which propose a duration of any reasonable length, up to 20 years,
— To give interested organisations as much information and background as possible about the Red Lion Quarter and the Council’s aspirations for its future, we have arranged a briefing meeting to which all such bodies are invited. Description of particular conditions: The supplier agrees that there shall be no discrimination by it against any person with respect to opportunity for employment or conditions of employment, because of age, culture, disability, gender, marital status, race, religion or sexual orientation. The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement, and the contract will be awarded on the basis of the most economically advantageous tender.

Precise information on deadline(s) for lodging appeals: ESPO on behalf of South Holland District Council will incorporate a minimum 10 calendar days standstill period at the point information on the decision to award the contract is communicated to tenderers. This decision notice will incorporate the award criteria, the reasons for the decision, the reasons (if any) why a tenderer did not meet any technical specification, the identity of the successful tenderer(s) and a precise statement of when the standstill period is expected to end. Any appeal or challenge against the award decision must be communicated to the address stated in section I.1 within the standstill period. If an appeal or challenge regarding the decision to award the contract has not been successfully resolved the Public Contracts Regulations 2006 (as amended) provide for aggrieved parties who have suffered harm or are at risk of harm by a breach of the procurement rules to take action in the High Court (England Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months) (NB this time limit may be reduced to 30 days in circumstances where the contract award has been publicised to all participants in accordance with the Regulations). Where a legal challenge is launched against the award decision ESPO is obliged to suspend the making of the contract. Where a challenge is made after the contract has been entered into then that contract could be declared ineffective and/or shortened and/or a fine imposed by the court, but only where the court are satisfied that there has been a serious breach of the procurement rules.
