The Authority intends to award a contract for the provision of cleansing of public conveniences situated on the Isle of Anglesey. The Contract will commence on or around 1.4.2012 and continue for an initial term of 5 years. The Authority will have the right to extend the Contract on one or more occasions up to a further aggregate period of 2 years. Further information in respect of the public convenience cleansing services Contract is set out in the Invitation to Tender, which will be made available to those organisations that express an interest in the Contract.

Description of these options: The Authority intends to award a Contract for the provision of cleaning of public conveniences situated on the Isle of Anglesey. The Contract will commence on or around 1.4.2012 and continue for an initial term of 5 years, subject to the Authority's right to extend the Contract on one or more occasions for up to a further aggregate period of 2 years.

Information and formalities necessary for evaluating if the requirements are met: The Invitation to Tender (ITT) specifies the information each organisation is required to submit with its tender to enable the Authority to evaluate, inter alia, each organisation's economic, financial, technical and professional capacity including confirmation from each organisation that it is eligible to tender in accordance with regulation 23 of the Public Contracts Regulations 2006 (the Regulations).

III.2.2) Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: The ITT specifies the information each organisation is required to submit with its tender to enable the Authority to evaluate, inter alia, each organisation's economic, financial, technical and professional capacity including confirmation from each organisation that it is eligible to tender in accordance with regulation 23 of the

Regulations.

Minimum level(s) of standards possibly required: Notwithstanding evaluation of the information provided to the Authority in accordance with the ITT, the Authority's minimum requirements for financial considerations (in accordance with regulation 15(12) of the Regulations) relates to the contract limit, which is the maximum contract value that a tenderer should be expected to tackle within its financial capacity. The Authority will use a notional calculation to calculate the contract limit, based on turnover of the tenderer in order to confirm whether the tenderer is large enough to perform the contract. The contract limit is calculated by taking the tenderer's average turnover for the last 3 years and halving it. If the tenderer's tendered annual contract price exceeds the contract limit, it is unlikely that the tenderer on its own has adequate resources to perform the services. The Authority will adopt the following approach when evaluating an organisation's economic and financial standing:

— where the tendered contract price is greater than the contract limit, tenderers may be eliminated from the procurement process. The decision to allow an organisation to continue in the process is entirely at the Authority’s discretion. Where a tenderer remains in the process the Authority willrequire a parent company guarantee or bond or deed, provided the parent itself is suitable,

— where the tendered contract price is between 60 % and 100 % of the contract limit, the Authority will continue the financial appraisal and procurement process but a parent company guarantee or bond or deed will be required, provided the parent itself is suitable,

— where the tendered contract price is below 60 % of the contract limit, the financial appraisal and procurement process shall continue.

The Authority will also undertake a financial assessment of the tenderer, sub-contractors (if known) and if applicable the parent company including an audit of their last three years’ accounts. The Authority must be confident of a supplier's ability to fulfil a contract.

VI.4.2) Lodging of appeals

Precise information on deadline(s) for lodging appeals: The Authority will communicate to tenderers and candidates its decision to award the Contract. In accordance with the Public Contracts (Amendment) Regulations 2009 (the Regulations) the Authority will include within its notice to tenderers and candidates the criteria for the award of Contract, the reasons for the decision to award the Contract, and why a candidate was unsuccessful. The standstill period will commence on the date that this notice is issued to the tenderers and candidates, and will conclude (at the earliest) at midnight on the 10th day after the notice was sent. For the avoidance of doubt, the Authority will also include a statement within its notice to tenderers and candidates specifying the timing of the standstill period in accordance with regulations 32 and 32A of the Regulations. The Authority will not enter into the Contract before the end of the standstill period. If an appeal regarding the award of the Contract has not been successfully resolved the Public Contracts Regulations 2006 (as amended by the Regulations) provide for an aggrieved party who has been harmed or is at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months subject to specific exemptions).
