The Mersey Gateway Project involves the design, build and operation of a new bridge crossing over the Mersey Estuary at Halton (Project). Part of the works forming the Project involve the construction of new road junctions in Widnes in order to connect the new crossing to the existing road network. One such junction is proposed to connect with the southern section of the existing Widnes Eastern Bypass at the present site of the Catalyst Trade Park, which is the former site of the ICI chemical works and is known to be contaminated with potentially harmful chlorinated solvents potentially present as free product.
A detailed quantitative risk analysis have been undertaken in consultation with Regulators (Environment Agency) and Halton Borough Council has concluded that certain remediation works (described in more detail in section II.2.1 below) are required at this site. These works are programmed to take place as part of the advanced works for the project.

II.2) Quantity or scope of the contract
II.2.1) Total quantity or scope:
The following primary works shall be provided under the remediation contract to the extent required:
a) Design, carry out and report on field trials to demonstrate‘best practicable technique’ to the Regulators;
b) Undertake remediation works as follows:
i. Dense non aqueous phase liquid (DNAPL) recovery is required. The remediation target has been defined as‘betterment’ within a given timeframe rather than using a set of defined acceptance criteria. The remediation contractors are to define ‘betterment’ in conjunction / agreement with the Regulators and Mersey Gateway Project Team;
ii. No specific groundwater remediation works are required; and
iii. No specific remediation works are required for bowers brook.
In order to undertake the above works, the following additional works will also be required:
a) Production of health and safety documentation required to fulfil the role of principal contractor in accordance with the CDM Regulations (2007). All documents are to be approved by the appointed CDM co-ordinator. Documentation will include, but not necessarily limited to the health and safety plan, method statements and training records;
b) Production and approval with the Regulators \ Mersey Gateway Project Team of the following reports:
i. Detailed remediation strategy;
ii. Verification plan;
iii. Monitoring&maintenance plan;
iv. Action plan;
v. Verification report; and
vi. Monthly progress update reports.
c) Obtain any necessary permits and consents to allow the remediation works to be undertaken, including but not necessarily limited to mobile treatment licences and deployment forms, consents to investigate water resources, abstraction licences, discharge consents (to sewer or to groundwater), environmental permits or exemptions from relevant environmental regulations;
d) Any additional ground investigations, testing (both in-situ and ex-situ), analysis and/or monitoring required to support the proposed remediation technique;
e) Decommissioning of existing monitoring wells in areas where required;
f) Removal, as required to enable remediation works, of hardstanding, buried obstructions, pile caps and / or piles;
g) Removal, sealing, grouting or re-routing of drains or other services as required to enable remediation works;
h) Provide necessary infrastructure, including but not necessarily limited to roadways, parking areas, bunding and hardstanding for cabins or treatment plant;
i) Monitor, survey and where necessary removal of radioactive materials, if required, possibly using a specialist contractor (depending on risks and expertise required);
j) Site management (including but not necessarily limited to staff welfare facilities, traffic management, noise / dust / vapour monitoring and suppression, consultation and liaison with the Regulators etc);
k) Maintenance of fencing at site boundary (erected by Halton Borough Council as part of the enabling works);
l) Make the necessary arrangements with Halton Borough Council and service providers for connections to services necessary to undertake the remediation works (electrical supply, mains water and foul drains, for example);
m) Monitoring of water quality at Bowers Brook outfall (frequency to be agreed with the Regulators);
n) Undertake the verification activities as detailed in the verification report and agreed with the regulators (to include monitoring for compliance of any environmental permits / exemptions / consents);
o) Regular site meetings between the remediation contractor, the Environment Agency and Halton Borough Council and its advisors;
p) Consultation and liaison as required for the remediation works with the regulators. Other liaison will be undertaken by the Mersey Gateway Project Team whom the remediation contractors will be expected to liaise with; and
q) Provision of security on site.

Single legal entity or consortium. Where a consortium or other grouping of suppliers submits a bid, such consortia or groupings must nominate a lead organisation to liaise with Halton Borough Council on all matters relating to the works. All consortium members or groupings will be required to be jointly and severally liable in respect to the obligations and liabilities relating to the works.

(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession;
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register;
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process;
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation;

VI.4.2) Lodging of appeals
Precise information on deadline(s) for lodging appeals: Halton Borough Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to candidates. candidates that are unsuccessful shall be informed by the Halton Borough Council as soon as possible after the decision has been made as to the reasons why the candidate was unsuccessful. If an appeal regarding the award of thecontract has not been successfully resolved, The Public Contracts Regulations 2006 (SI 2006 No. 5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the High Court (England, Wales, and Northern Ireland). Any such action must generally be brought within 3 months. If a declaration of ineffectiveness is sought, any such action must be brought within 30 days where Halton Borough Council has communicated the award of the contract and a summary of reasons to candidates, or otherwise within 6 months of the contract being entered into. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order Halton Borough Council to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order Halton Borough Council to pay a fine, and/or order that the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
